1. The Virtual Artist and Content
Virtual Persona: You understand That Ivy Bat is a virtual group of character, digital persona, and/or AI-generated entity(ies). All content, including voice, image, music and lyrics, and personality (ies), are owned by Tabitha Jones and/or Ivy and Bat LLC.
Intellectual Property: All content on this site, including music, videos, graphics, designs, logos, and character images, is the property of Tabitha Jones and is protected by copyright and intellectual property laws.
Permitted Use: You are granted a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial, entertainment purposes. You may not reproduce, distribute, modify, or create derivative works of any content without explicit written permission from Tabitha Jones or her agents.
2. Online Store and Digital Goods
Digital Downloads/Licenses: Items sold in the store, such as music files (MP3/WAV), digital art, or wallpapers, are licensed, not sold. You are purchasing a license for personal, non-commercial use only.
No Resale: You may not redistribute, resell, or share digital downloads with third parties.
Physical Merchandise: For physical items, orders are subject to availability and acceptance. We reserve the right to refuse service to anyone for any reason.
Returns & Refunds:
Digital Goods: Due to the nature of digital products, all sales are final and non-refundable.
Physical Goods: Returns are accepted within 10 days of receipt, provided the item is unused and in its original packaging. Shipping costs are non-refundable. Tracking is always provided and delivery will be noted.
3. User Accounts and Conduct
Accounts: You may be required to register an account to make purchases. You are responsible for keeping your account information, including password, secure and confidential.
Prohibited Activities: You agree not to use the site to:
Harass, abuse, or threaten the virtual artist or other users.
Attempt to impersonate the virtual artist or staff.
Use automated systems (bots) to spam, scrape, or interfere with the site.
Upload malicious code or viruses.
Termination: We reserve the right to terminate your account and access to the site immediately, without prior notice, if you violate these terms.
4. User-Generated Content (Fan Art/Covers)
If you share fan art, covers, or fan-made content on any site or linked social media, or in any physical instance, you grant Ivy Bat, Ivy and Bat LLc, and Tabitha Jones a worldwide, royalty-free license to display, reproduce, and share your work, provided we credit you. You are not licensed to sell any fan made content you might create. This includes at conventions and events, online, or in stores or any other instances.
5. Limitation of Liability
The website and all content are provided "as is," without warranties of any kind. We do not guarantee that the site will be uninterrupted or error-free.
You agree that Tabitha Jones, Ivy Bat, and Ivy and Bat LLC shall not be liable for any damages (including direct, indirect, or consequential damages) arising from your use of the site or the purchase and use of products.
6. Governing Law and Disputes
These Terms are governed by the laws of Arkansas and the United States of America. Any disputes shall be resolved in the courts located in Clarksville, Arkansas USA.
GDPR Compliant Privacy Policy
We receive, collect and store any information you enter on our website or provide us in any other way. In addition, we collect the Internet protocol (IP) address used to connect your computer to the Internet; login; e-mail address; password; computer and connection information and purchase history. We may use software tools to measure and collect session information, including page response times, length of visits to certain pages, page interaction information, and methods used to browse away from the page. We also collect personally identifiable information (including name, email, password, communications); payment details (including credit card information), comments, feedback, product reviews, recommendations, and personal profile.
When you conduct a transaction on our website, as part of the process, we collect personal information you give us such as your name, address and email address. Your personal information will be used for the specific reasons stated above only.
We collect such Non-personal and Personal Information for the following purposes:
To provide and operate the Services;

Our company is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall.
All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.
